MADRID, 23 Ene. - PSOE, Sumar, ERC, Bildu, PNV, Junts per Catalunya, and Podemos have agreed on Tuesday to exclude terrorism offenses from the amnesty law project "provided that they have manifestly and directly caused serious violations of human rights," which would allow for the amnesty of the 12 members of the Committees for the Defense of the Republic (CDR) and the 10 individuals accused of the disturbances allegedly promoted by 'Tsunami Democrátic' that have been investigated at the National Court.

This agreement was reached within the framework of the Justice Committee of the Congress, where various technical amendments to the law proposed by the PSOE last November to grant amnesty for a decade of the Catalan independence 'procés' were agreed upon.

Among the agreed amendments, terrorism remains as an excluded offense from the amnesty, aligning its structure with the rest of the exclusions provided for in the law. In addition, the parameters established by the European Convention for the Protection of Human Rights and Fundamental Freedoms are used as a clear and internationally recognized reference for this issue.

Parliamentary sources have stated that this modification provides "greater clarity and comprehensiveness" to the article on the effects of amnesty in the criminal sphere, in order to provide this section with "greater legal certainty."

Furthermore, the judicial function of judges and magistrates is reinforced when applying these effects, especially regarding the lifting of precautionary measures in the event of a suspension of the judicial process for any reason.

It should be noted that last week, Junts and ERC proposed a series of partial amendments to the amnesty law to ensure that the norm encompassed all terrorist offenses for which the independence movement is accused.
